Landlord Barred From Demolishing Building and Required to Complete Building Repairs for Tenants
A landlord sought permission from the Court to demolish a building, partially destroyed by fire, and to compel the remaining tenants to pay rent for the period of time that they remained in occupancy. David Weinraub represented the tenants. The Court held that the tenants were under no obligation to pay rent due to the conditions in the building. It also denied the landlord permission to demolish the building, holding that the landlord must first obtain DHCR approval. The Court compelled the landlord to make the needed repairs to the building, and the tenants were able to retain their homes.
